Legislation and approvals

The Spinifex Offshore Wind Farm is in the pre-planning phase. This period involves investigations about wind speeds, ocean conditions and environmental impacts.


To operate, the Spinifex Offshore Wind Farm will need approval under the following acts:

  • Commonwealth Environment Protection and Biodiversity Conservation Act 1999
  • Victorian Planning and Environment Act 1987
  • Victorian Marine and Coastal Act 2019
  • Victorian Aboriginal Heritage Act 2006
  • The Underwater Cultural Heritage Act 2018
  • Commonwealth Offshore Electricity Infrastructure Act 2021

The environmental studies and approvals process

The project will have a clearer understanding of environmental approval timelines once feasibility licenses are awarded for the Southern Ocean Region.

The project will be referred to the relevant Commonwealth and Victorian state authorities to determine what environmental assessments and approvals will be required.

The relevant authorities will decide how the project should be assessed and provide details on the scope of environmental and social investigations and studies.

The project will undertake the required environmental and social investigations and studies to understand possible project impacts and mitigations.

The project submits findings from the studies and investigations, likely impacts and proposed mitigations to the relevant authorities for environmental assessment and approvals.

The relevant authorities assess the information and determine whether approvals should be issued and what conditions should apply.
